These Terms of Service ("Terms") govern your access to and use of BLKJ, a product of ("Black Journal," "we," "us," or "our"). By downloading, installing, accessing, or using BLKJ, you agree to be bound by these Terms. If you do not agree, do not use BLKJ.
BLKJ is a research and decision-support tool for prediction market trading. It classifies publicly available market data against a set of user-configurable rules, probability zones, and situational signals, and presents that classification to you for your own review.
BLKJ ships with a set of default rules, probability zone thresholds, and stake sizing presets. These defaults are a generic starting baseline meant to illustrate how the system works, they are not personalized recommendations based on your financial situation, risk tolerance, or objectives, and Black Journal has no visibility into, and no involvement in, which settings you ultimately choose to run. You may modify, disable, or replace every rule, zone, and threshold in BLKJ. The classification any given market receives (for example, "Sweet Spot," "Borderline," or "No Play") is generated mechanically from the settings you have configured, applied identically to the available markets, not from an independent judgment by Black Journal about the wisdom of that specific trade for you.
BLKJ is designed as a research and discipline tool, not a betting product. It does not use leaderboards, win streaks, or other engagement mechanics designed to encourage additional trading activity. Its function is to slow down and structure your own decision-making process against criteria you set, not to prompt more frequent trades.
BLKJ is not a broker-dealer, futures commission merchant, exchange, sportsbook, or investment adviser. BLKJ does not hold your funds, does not take the other side of any trade, and does not execute trades autonomously on your behalf. Every trade placed through BLKJ requires your own manual confirmation.
BLKJ is not affiliated with, endorsed by, or sponsored by Kalshi or KalshiEX LLC. "Kalshi" is used in these Terms solely to describe the third-party exchange BLKJ connects to at your direction.
Black Journal offers BLKJ in two ways: as locally-run software that you install and operate yourself, connecting directly from your own device to your own Kalshi account ("Local Software"), and as a hosted, account-based web application operated by Black Journal ("Web App"). Sections 8 and 9 below apply specifically to the Local Software. Sections 10 through 13 apply specifically to the Web App. All other sections of these Terms apply regardless of which version of BLKJ you use. If you use both, the version-specific sections apply to the respective version you are using at that time.
Nothing in BLKJ constitutes investment advice, trading advice, or a recommendation to buy, sell, or hold any contract. Rule classifications, probability zones, "Sweet Spot" or "Borderline" labels, and the morale meter are informational tools only, based on criteria you configure yourself. They are not predictions of outcome and do not guarantee any result.
Because these classifications are generated from rules and thresholds that you set, and because BLKJ's default presets are a generic baseline rather than advice tailored to your individual circumstances, any classification you see reflects your own configured criteria being mechanically applied to public market data, not a personalized recommendation from Black Journal about that specific trade.
You are solely responsible for every trading decision you make, whether or not it aligns with BLKJ's classification of a given market.
Trading on prediction markets involves substantial risk of loss, including the potential loss of your entire stake on any given position. Past performance, including any backtest data, sample results, or historical win rates referenced by Black Journal, is not indicative of future results. Black Journal makes no guarantee, express or implied, regarding the profitability of using BLKJ.
BLKJ, as currently offered, is scoped to sports-related prediction markets available on Kalshi. Black Journal may in the future expand BLKJ or introduce related products covering additional asset classes, including cryptocurrency or equities. Any such expansion will be governed by updated or additional terms specific to that asset class, which may carry different regulatory requirements than prediction markets.
This section applies if you run BLKJ as Local Software. BLKJ connects to Kalshi using API credentials that you generate and control. Your API key and private key are stored locally on your own device and are not transmitted to Black Journal, because the Local Software does not communicate with any Black Journal server. You are solely responsible for the security of your own API credentials, your own device, and your own Kalshi account. Black Journal is not responsible for any loss resulting from a compromised device, leaked credentials, or unauthorized access to your local machine.
Black Journal does not currently charge for the Local Software. If this changes, you will be notified in advance of any charge applying to the Local Software specifically.
The Local Software does not require you to create a Black Journal account, and Black Journal does not operate a central server that the Local Software depends on to function. You may use the Local Software indefinitely, independent of whether you also use the Web App described below.
This section applies if you use the hosted BLKJ Web App. To use the Web App, you must create an account and provide accurate registration information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Black Journal promptly at support@blkj.ai if you suspect unauthorized access to your account.
The Web App is offered on a subscription basis at $4.99 per month, beginning with a 7-day free trial. If you do not cancel during the free trial, your paid subscription begins automatically at the end of the trial and your payment method is charged $4.99 for the first month. Unless canceled, your subscription then automatically renews at the end of each billing period at the then-current price, and you authorize Black Journal, through its payment processor, to charge your payment method accordingly.
Cancellation and refunds. You may cancel at any time in a single step from your account settings, no phone call, email, or retention flow is required. If you cancel during the free trial, you are not charged. After your free trial ends and your first payment is charged, you may request a full refund of that charge at any time within thirty (30) days of the charge, directly from your account and with no manual approval required; your access ends when the refund is issued. This 30-day money-back guarantee is limited to one (1) refund per account, ever: once a refund has been issued to an account, no further refunds are provided on that account, including on any subsequent resubscription. If you cancel more than thirty (30) days after a charge, or after a refund has already been used on your account, no refund is provided for the period already paid, no further charges are made, and your access continues until the end of that paid period. Additional refunds are provided where required by law. Closing your account (as opposed to canceling the subscription) starts the data-retention period described in the Privacy Policy, after which your data is permanently deleted.
This section applies if you use the hosted Web App.
Credentials never reach Black Journal's servers: Even on the Web App, your Kalshi API credentials are used only within your own browser session to communicate directly with Kalshi. Black Journal's servers do not receive, store, or have access to your Kalshi API key or private key at any point.
This section applies to the Web App. Black Journal will use reasonable efforts to keep the Web App available, but does not guarantee uninterrupted access. Scheduled maintenance, technical issues, or events outside Black Journal's control may make the Web App temporarily unavailable. Black Journal is not liable for any consequence of the Web App being unavailable at a particular moment, including if you were unable to view a classification or place a trade as a result.
Except for disputes eligible for small claims court, any dispute arising out of or relating to these Terms or your use of BLKJ will be resolved through binding, individual arbitration rather than in court. YOU AND BLACK JOURNAL EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
BLKJ, including its rules framework, probability zone methodology, software, design, and branding, is the property of Black Journal. You may use BLKJ for your own personal trading activity. You may not copy, resell, sublicense, reverse engineer, or redistribute BLKJ without Black Journal's prior written consent.
BLKJ IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BLACK JOURNAL DOES NOT WARRANT THAT BLKJ WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CLASSIFICATION, PROBABILITY, OR SCORE DISPLAYED WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACK JOURNAL AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY TRADING LOSSES, LOST PROFITS, OR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF BLKJ, INCLUDING LOSSES INCURRED ON TRADES PLACED ON KALSHI, WHETHER OR NOT YOU RELIED ON A CLASSIFICATION OR SCORE DISPLAYED BY BLKJ.
You agree to indemnify and hold harmless Black Journal from any claim, loss, or demand arising out of your use of BLKJ, your trading activity on Kalshi, or your violation of these Terms.
Black Journal may suspend or terminate your access to BLKJ at any time, for any reason, including violation of these Terms. You may stop using BLKJ at any time. If your Web App account is terminated or you cancel your subscription, your account data will be handled as described in the Privacy Policy's data retention section.
Black Journal may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date. Continued use of BLKJ after changes take effect constitutes acceptance of the revised Terms.
